Terms1.1. The real offer is the official offer of MalibuFIT, hereinafter referred to as the “Seller”, to conclude the Agreement for the sale of goods remotely, i.e. through remote access, hereinafter referred to as the “Agreement”, and places the Public Offer (offer) on the official website The seller of malibufit.club (hereinafter referred to as the "Company Site").1.2. The moment of complete and unconditional acceptance by the Buyer of the Seller's proposal (acceptance) to conclude an electronic contract for the purchase and sale of services is considered the fact of payment by the Buyer of the order under the terms of this Agreement, within the time and at the prices indicated on the Seller's website.
Concepts and definitions2.1. In this offer, unless the context otherwise requires, the following terms have the following meanings:* "Service" - fitness services;* "Seller" is a company that provides services presented on the Company's Website.* "Buyer" is a natural person who entered into an Agreement with the Seller under the conditions set forth below.* "Order" - selection of individual items from the list of services specified by the Buyer when placing the order and making payment.
Scope of the contract3.1. The Seller undertakes to hand over the Service to the Buyer, and the Buyer undertakes to pay for and accept the Service under the terms of this Agreement.This Agreement regulates the purchase and sale of services on the Company's Website, including:– voluntary choice by the Buyer of services on the Company's Website;- independent placing of an order by the Buyer on the Company's Website;– payment by the Buyer of the order placed on the Company's Website;- processing and delivery of the order to the Buyer under the terms of this Agreement.Procedure for placing an order4.1. The buyer has the right to place an order for any service presented on the company's website and available.4.2. Each item can be represented in the order in any quantity.4.3. In the absence of the service, the Company Manager is obliged to inform the Buyer (by phone or e-mail).4.4. In the absence of a service, the Buyer has the right to replace it with a service of a similar category, to refuse this service, to cancel the order.
Rights and duties5.1. The seller has the right:- to unilaterally terminate the provision of services under this contract in case the Buyer violates the terms of this contract.5.2. The buyer is obliged to:- to pay and receive the order in a timely manner under the terms of this contract.5.3. The buyer has the right to:- place an order on the company's website;- draw up an electronic contract;- to require the Seller to fulfill the terms of this Agreement.
The procedure for returning goods of appropriate quality6.1. The return of services purchased on the company's website is carried out in accordance with the current legislation of Ukraine.6.2. The return of the service purchased on the Company's Website is carried out at the expense of the Buyer.6.3. When the Buyer returns the service, the Company's Site returns the amount paid for the service upon the fact of returning the service.
Rights and duties7.1. An electronic contract is considered to have been concluded from the moment the person who sent the proposal to conclude such a contract receives a response about the acceptance of this proposal in the manner specified by part six of Article 11 of the Law of Ukraine "On Electronic Commerce".7.2. Prior to the expiration of this Agreement, this Agreement may be terminated by mutual consent of the parties prior to the start of the service, by refunding money7.3. The parties have the right to terminate this agreement unilaterally, in the event of non-fulfillment of the terms of this agreement by one of the parties.
